The attorney mentions that under New York law, there are three crimes that qualify as forms of aggravated assault. These are aggravated assault while driving a vehicle, aggravated assault on a police officer, aggravated assault on a person under 11 years of age.
“If a weapon is alleged to be involved in an assault, it will be a felony charge. If a person is charged with causing an injury with a deadly weapon or dangerous instrument, they will be charged with second degree assault (Criminal Law 120.05-2), which is a class D violent felony. If a person is charged with causing a grievous bodily injury with a deadly weapon or dangerous instrument, she will be charged with first degree assault (Criminal Law 120.10-1), which is a Class B violent felony,” states the Suffolk County DWI misdemeanor attorney.
The attorney explains that for a serious assault while driving a vehicle, a person is charged if they engaged in reckless driving. It will be a second degree assault while driving if the individual was engaged in reckless driving along with a few other factors. These factors include driving with a BAC or BAC of 0.18%, driving with a suspended or revoked license, and having been convicted of manslaughter.
Lawyer Jason Bassett also mentions that the second type of aggravated assault is the aggravated assault on a police officer or peace officer. This happens when a person intends to cause serious injury to someone they knew or reasonably knew to be a police officer or peace officer.

This happens when a person is accused of assaulting someone under the age of 11. A person who has already been convicted of this type of assault within the previous 10 years is more likely to be charged with this type of assault.
